Terms of Service

1. Acceptance

By creating a LocalSpark AI account or using the service, you agree to these Terms. If you do not agree, do not use the service.

2. Eligibility and your account

You must be at least 18 years old and able to enter a contract. You are responsible for the accuracy of your account details, for keeping your password secure, and for all activity under your account.

3. What LocalSpark AI does

LocalSpark AI helps local businesses create social media content. It generates captions, post ideas, monthly content plans, review replies, and Reel concepts using the business information you provide. In the current version LocalSpark does not post to Instagram, Facebook, TikTok, or Google Business on your behalf, and it does not generate AI video. Publishing is done by you.

4. Subscription plans

Paid plans (Starter $19/month, Growth $49/month, Pro $99/month) include a monthly allowance of AI actions. Allowances reset each billing period and unused allowance does not roll over. Plan details shown in the app and on the pricing section are the authoritative description of what each plan includes.

5. Free trial

New accounts may receive a 7-day free trial with a limited allowance and no payment card required. Trial eligibility is determined by LocalSpark. When a trial ends, your account and previously generated content remain available, but new AI generation requires a paid plan.

6. Billing and renewal

Paid plans bill monthly in advance through Stripe and renew automatically until cancelled. Prices are in US dollars and exclude any applicable taxes. You authorise recurring charges to your payment method until you cancel.

7. Cancellation

You may cancel at any time from your Account page or the Stripe customer portal. Cancellation takes effect at the end of the current billing period, and you keep access until that date.

8. Refunds

Except where required by law, payments are non-refundable and cancelling stops future charges rather than refunding the current period. [Refund policy — the business owner should confirm or replace this default before launch.]

9. AI-generated content

Content produced by LocalSpark is generated by an AI model using the business information you supply. LocalSpark is designed to ground content in your saved services, promotions, and photo details, and not to invent services, discounts, testimonials, or business claims. AI systems can still make mistakes.

You are responsible for reviewing every post before publishing it, including prices, offers, dates, availability, and any factual claim about your business.

10. Prohibited use

You agree not to use LocalSpark to:

• create false, deceptive, or misleading advertising;
• upload content you do not have the right to use;
• produce unlawful, harassing, hateful, or adult content;
• impersonate another business or person;
• attempt to bypass usage limits, security controls, or other customers' data;
• resell or redistribute the service without permission.

11. Content you upload

You keep ownership of the photos, videos, business details, and reviews you upload. Uploading content does not transfer ownership to LocalSpark. You grant LocalSpark a limited licence to store and process that content solely to operate the service for you — for example to generate posts and display your media library.

12. Intellectual property

LocalSpark owns the software, branding, and interface. Subject to these Terms, the content generated for your business is yours to use in your own marketing.

13. Availability and changes

The service is provided on an ongoing basis but may change, and features may be added, modified, or removed. We aim to give reasonable notice of material changes to paid plan allowances or pricing.

14. Termination

You may delete your account at any time from the Account page. LocalSpark may suspend or terminate accounts that violate these Terms or that create legal or security risk.

15. Disclaimers

The service is provided "as is" without warranties of any kind. LocalSpark does not guarantee followers, engagement, leads, revenue, or any particular marketing result.

16. Limitation of liability

To the maximum extent permitted by law, LocalSpark's total liability arising from the service is limited to the amount you paid in the twelve months before the claim. LocalSpark is not liable for indirect, incidental, or consequential damages, including lost profits or reputational harm.
